This User Agreement governs your use of the MistyLens app, a cinematic photo application that allows you to capture or import photos, apply AI-powered cinematic styles, adjust intensity and film grain, add artistic text overlays, and save your edits to your device’s photo album and the App’s history feature. By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, please do not use the App.
All information is processed locally, information is only retained on the user’s local device, and when the user actively deletes the information, the information will be deleted, so the app does not collect any facial data. This principle applies to all aspects of your use of the App, ensuring that your personal data and related content are fully under your control at all times.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device for your personal, non-commercial use only. This license does not grant you any rights to the App’s source code, intellectual property, or any other proprietary information of MistyLens. You may not modify, reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, nor may you create derivative works based on the App. All information generated during your use of the App is processed locally and only retained on your device, and will be deleted when you actively choose to delete it, so the app does not collect any facial data.
When using the App, you agree to comply with all applicable rules and regulations, and to use the App in a manner that is legal, ethical, and respectful of others. You agree not to use the App to capture, import, or edit any photos that are illegal, obscene, defamatory, harassing, threatening, or infringing on the intellectual property or privacy rights of others. You are solely responsible for the content of the photos you use in the App and for any consequences resulting from your use of such content. All photos and related data you use in the App are processed locally on your device, retained only on your device, and deleted when you actively delete them, so the app does not collect any facial data.
You agree not to use the App in any way that could damage, disable, overburden, or impair the App or our services, nor may you attempt to gain unauthorized access to the App, its features, or any related systems or networks. You may not use any automated tools, bots, or scripts to access or use the App, and you may not share your device’s access to the App with others in a way that violates this Agreement. Users must be 18 years of age or older to use the App, and all information of users 18 years of age or older is processed locally and only retained on their own devices.
All intellectual property rights in and to the App, including but not limited to copyrights, trademarks, service marks, patents, trade secrets, and any other proprietary rights, are owned by us or our licensors. The App’s name, logo, cinematic styles, features, and any content provided through the App excluding your photos and edits are protected by intellectual property laws. You may not use any of our intellectual property without our prior written permission.
You retain all intellectual property rights to the photos you capture or import using the App, as well as any edits you make to those photos. By using the App to edit your photos, you grant us a limited, non-exclusive license to process your photos solely for the purpose of providing you with the App’s features such as applying cinematic styles and adjustments, which is necessary to deliver the services you request. This license does not allow us to use your photos for any other purpose. All your photos and related data are processed locally, retained only on your device, and deleted when you actively delete them, so the app does not collect any facial data.
MistyLens does not collect any facial data. Whether the photos you capture or import contain human faces or not, our App only processes the photos to apply the cinematic styles, intensity adjustments, film grain, and artistic text overlays you select. All processing is done locally on your device, and all information is only retained on your device and will be deleted when you actively delete it. Your photos and any related data remain your property and under your complete control.
The App is provided to you on an as is and as available basis, without any warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components. We do not warrant that the App will meet your specific needs or expectations, or that the cinematic styles, adjustments, or other features will produce any particular results. Your use of the App is at your own risk, and we shall not be liable for any damage or loss resulting from your use of the App. All information generated during your use is processed locally and only retained on your device, so the app does not collect any facial data.
In no event shall we be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, data, or other intangible losses, resulting from your use or inability to use the App. This limitation of liability applies regardless of whether the damages are caused by negligence, breach of contract, breach of warranty, or any other legal theory, and even if we have been advised of the possibility of such damages.
We shall not be liable for any damage to your device, loss of photos, or other data resulting from your use of the App. It is your responsibility to back up your photos and other important data regularly, and we recommend that you do so before using the App to avoid any potential loss. All your data is processed locally and only retained on your device, and you can delete it at any time.
This Agreement shall remain in effect until terminated by either you or us. You may terminate this Agreement at any time by uninstalling the App from your device. When you uninstall the App, all related information stored on your device will be deleted in accordance with the principle that all information is only retained on the local device and deleted when the user takes the initiative. We may terminate this Agreement at any time, with or without notice, if you violate any of the terms and conditions of this Agreement. Upon termination, your license to use the App shall immediately terminate, and you shall uninstall the App from your device and delete any app-related data stored on your device.
We may update this Agreement from time to time to reflect changes to the App, our services, or applicable rules. Any updates to this Agreement will be posted within the MistyLens App, and your continued use of the App after the updates are posted will constitute your acceptance of the revised Agreement. We encourage you to review this Agreement periodically to stay informed about the terms governing your use of the App. The revised Agreement will still adhere to the principle that all information is processed locally, retained only on the user’s device, and deleted when actively deleted, so the app does not collect any facial data.
